Welcome to No-Bull Marketing. These Terms of Service (“Terms”) govern your use of our website, products, services, and marketing solutions provided by No-Bull Marketing (“Company,” “we,” “our,” or “us”).

By using our website or purchasing services from us, you agree to these Terms.

1. Services Provided

No-Bull Marketing provides marketing and advertising services including, but not limited to:

  • Direct mail marketing
  • EDDM (Every Door Direct Mail) campaigns
  • Graphic design
  • Printing coordination
  • Digital advertising
  • Social media marketing
  • Website development
  • AI-powered marketing solutions
  • SMS and email marketing
  • Promotional product and POP (Point-of-Purchase) material design

Services may be customized per client agreement, proposal, invoice, or statement of work.

2. Client Responsibilities

Clients agree to:

  • Provide accurate information, artwork, approvals, and mailing data
  • Review proofs and approvals carefully before production
  • Ensure all submitted content complies with applicable laws and regulations
  • Obtain any required permissions for trademarks, images, mailing lists, or customer data

The client is solely responsible for final approval of all materials before printing, mailing, or publication.

3. Payments & Billing

Payment terms may vary depending on project scope and production requirements.

Unless otherwise agreed in writing:

  • Deposits may be required before production begins
  • Large print or direct mail projects may require payment prior to mailing or shipment
  • Invoices are due according to the terms stated on the invoice
  • Failure to make timely payment may delay production, mailing, shipment, or campaign launch

All payments processed through Stripe are subject to Stripe’s terms and security protocols.

4. Refund Policy

Because many of our services involve custom creative work, printing, postage, labor, and third-party production costs, refunds are limited as follows:

Non-Refundable Services

The following are generally non-refundable once work has begun or approvals have been provided:

  • Graphic design services
  • Custom artwork
  • Printing costs
  • Postage costs
  • Mailing services
  • Digital ad spend
  • Custom development work
  • POP materials
  • Promotional products

Refund Eligibility

Refund requests may be considered only when:

  • Services were not delivered as agreed
  • Production has not yet started
  • No third-party costs have been incurred

Approved refunds are issued to the original payment method.

5. Chargebacks & Disputes

Clients agree to contact No-Bull Marketing directly before initiating any payment dispute or chargeback.

We maintain documentation including:

  • Signed approvals
  • Email approvals
  • Proofs
  • Tracking information
  • Mailing documentation
  • Shipping confirmations
  • Invoices
  • Campaign records

Initiating fraudulent or unjustified chargebacks after services have been rendered may constitute breach of contract.

6. Production & Delivery Timelines

Production schedules and estimated delivery dates are estimates only and are not guaranteed unless explicitly stated in writing.

No-Bull Marketing is not liable for delays caused by:

  • USPS delays
  • Carrier delays
  • Weather events
  • Power outages
  • Vendor disruptions
  • Supply shortages
  • Force majeure events
  • Client approval delays

For direct mail campaigns, in-home delivery dates are estimates and may vary based on USPS processing.

7. Direct Mail & USPS Services

For mailing services:

  • Postage rates are subject to USPS changes
  • Mailing timelines depend on USPS processing and transportation
  • Client mailing lists must comply with all applicable laws
  • No-Bull Marketing is not responsible for inaccurate mailing data supplied by the client

USPS delivery windows are estimates only and are outside our direct control once mail is accepted by USPS.

8. Intellectual Property

Unless otherwise agreed:

  • Final paid creative assets delivered to the client become the client’s property for intended business use
  • No-Bull Marketing retains ownership of drafts, concepts, internal systems, software, workflows, and proprietary tools
  • We reserve the right to display completed work in portfolios or marketing materials unless restricted by written agreement

9. Limitation of Liability

To the fullest extent permitted by law:

No-Bull Marketing shall not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from the use of our services.

Total liability for any claim shall not exceed the amount paid by the client for the specific service giving rise to the dispute.

10. No Guarantee of Results

Marketing results vary and cannot be guaranteed.

We do not guarantee:

  • Specific sales increases
  • Lead volume
  • Advertising performance
  • Search engine rankings
  • Social media engagement
  • ROI or conversion rates

Past performance does not guarantee future results.

11. Cancellation Policy

Projects may be canceled in writing before production begins.

If cancellation occurs after work has started, the client remains responsible for:

  • Completed labor
  • Design time
  • Printing costs incurred
  • Postage committed
  • Vendor charges
  • Any non-recoverable expenses

12. Governing Law

These Terms shall be governed by the laws of the State of Arkansas, without regard to conflict of law principles.

Any disputes shall be resolved in the appropriate courts located in Arkansas.
